If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by Yellowneon.com and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Yellowneon.com and accessing the Website in connection with the provision of such services.

By accessing or using our Website, Service, or by purchasing Products you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms then you may not access the Website or Service.

Applicable Law and Jurisdiction:

This Agreement shall be governed by and construed in accordance with the laws of the United States and of the State of California, without regard to its conflicts of law principles. Any dispute regarding this Agreement shall be resolved in the Courts located in Los Angeles County, California without a jury (which is hereby expressly waived).

Changes to these Terms and Conditions:

We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. We will endeavor to highlight any significant or substantive changes to you where possible. If you choose to use our website then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and Yellowneon.com’s rights and obligations to each other.

Make your own custom sign & Custom Text Neon Builder usage terms

All quotes made using custom text neon sign builder programs at Yellowneon.com are the best estimation of the total cost. Yellowneon.com may by giving notice to the Buyer at any time up to seven (7) days before delivery increase the price of the goods to reflect any increase in the cost to Yellowneon.com beyond the reasonable control of Yellowneon.com which increase the cost of the Goods/Services by more than 15% of the quoted price.
Final drawings will often differ slightly from the concept made in the custom builder, normally only marginally but this is because of the way we cut and bend our LED neon to the shape (Handmade). The design on the custom builder will NOT mirror the true design, although we will do our best to get as close as we can. The actual sign shape may vary slightly from the final proof due to the handcrafted nature of the product. Customized and personalized Products are not eligible for returns or refunds.
All signs designed, estimated, quoted and produced on our custom text neon sign builder, via Email and/or text messaging are NOT waterproof . All of our custom led neon signs we produce are intended for indoor use only, and any outdoor usage will be done at your own discretion and expense.

Website Availability:

We reserve the right to modify, update, or discontinue Yellowneon.com at our sole discretion, at any time, for any or no reason, and without notice or liability.

Product Availability:

Custom Products are made to order. This includes the products in the Website shop section. We aim to deliver your product within 3-5 weeks for standard orders and within 2-3 weeks for express orders. We will make every effort to ensure your purchased product reaches you within the stated timeframe but we make no guarantees as issues can arise that are outside of our control.

Purchases:

If you wish to purchase any product or make use of any service made available through this Website, you may be asked to supply certain relevant information including, but not limited to, your name, email address, delivery address and payment information. For full information on what information we collect and how we use it please see our Privacy Policy.
Yellowneon.com reserves the right to change our prices at any time up to seven (7) days before delivery.
Yellowneon.com reserves the right to refuse or cancel certain orders at our sole discretion. You will be informed of any such refusal or cancellation within a reasonable timeframe, and a reason for the refusal or cancellation will be provided.

Returns & Refunds:

Customized and personalized products are not eligible for returns or refunds.
Yellowneon.com offers returns and refunds for Store products only. Store products are products that are purchased directly through the Shop section of our Website without any customization or personalization.

For all Store products we offer a return and refund policy with the following conditions:

• All products must be unopened and in their original condition.
• The return must be within 30 days of a purchase.

Our custom-made and personalized signs are handmade to order according to the customer's specific requirements. These unique products are therefore not subject to a 14 day cooling off period and cannot be returned for a refund unless they are damaged or defective upon arrival.

If the products arrive to the Buyer in a damaged state, the Buyer is required to notify the delivery agent and the Seller within 48 hours in writing including photographic evidence of the damage to the products and associated packaging to verify. Failure to comply with this request and timeframe will void the Seller obligations.
Due to the hand rendered nature of the products, they can be subject to variations and slight discolorations. Some variations in color can also occur as a result of the computer screen and printer calibration.
Also, small smudges and glue residues may appear on the LED tube or acrylic background due to the hand crafted manufacturing process. It will not be apparent when lit.
These variations, discolorations, and smudges are not considered as a fault of the products and accepts the potential of such occurrence.

The Buyer shall inspect the products on delivery and shall within 48 hours of delivery notify the Seller in writing of any alleged defect, shortage in quantity, damage or failure to comply with the description or quote. The Buyer shall afford the Seller an opportunity to inspect the products within a reasonable time following delivery. If the Buyer shall fail to comply with these provisions the Goods shall be conclusively presumed to be in accordance with the terms and conditions and free from any defect or damage.

Return shipping costs:

• If your Product is defective, Yellowneon.com will cover the cost of the return shipping.
• If the Product is not defective and you have simply changed your mind regarding the purchase, return shipping will be at your own cost.

Import Duty:

Please note that the purchaser is fully responsible for any import or custom duty charges.

Warranty:

Custom indoor products include a 12 month warranty which covers electrical components when used appropriately (Indoor use only).
Resolution for defective signs will be dependent on the source of the fault and will be determined between Yellowneon.com and You, the Buyer. Yellowneon.com will either fix, replace or refund the product.

Privacy:

We consider your privacy of utmost importance, please read our Privacy Policy.

Rights:

All Content included on the Website, unless uploaded by Users, is the property of Yellowneon.com, our affiliates or other relevant third parties. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users.
By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner's prior written permission.

Events of Force Majeure:

If a Force Majeure arises so as to wholly or partly prevent or delay either party performing its obligations under the Agreement, the affected party will not be liable for failing to perform this Agreement to the extent that it is prevented from doing so by the Force Majeure; use reasonable endeavors to remove the Force Majeure as quickly as practicable, but shall not be liable to settle any strike, lockout or other labor difficulty on terms not reasonably acceptable to that party; and notify the other party of the Force Majeure, its likely duration and the period (in that party's opinion) of any consequent delays or other relevant events.

Restrictions on Use:

You agree that you will not, and will not assist or enable others to:

• use Yellowneon.com to threaten, stalk, defraud, incite, harass, or advocate the harassment of another person, or otherwise interfere with another user's use of Yellowneon.com;
